SMS terms & conditions.

These SMS Terms & Conditions (“SMS Terms”) govern the SMS and text messaging programs operated by 415 Creative (“415 Creative,” “we,” “our”) on behalf of itself and its clients. By opting in to a 415 Creative SMS program, you agree to these SMS Terms. If you do not agree, do not opt in.

1. Program description

415 Creative operates a multi-tenant communications platform that delivers SMS messages on behalf of healthcare practices and service businesses (each, a “Client”). Current Clients include, but are not limited to, Napa Valley Lifestyle and Wellness, Whole Health Bariatric Center, and 415 Creative itself.

When you opt in to receive SMS from a Client through our platform, you may receive any of the following message types from that Client:

  • Appointment reminders (e.g., upcoming visit notifications)
  • Appointment confirmations
  • Post-visit follow-ups
  • Review requests (asking you to share your experience)
  • Inquiry follow-ups (responses to a contact form or chatbot conversation you initiated)
  • Conversational replies to messages you send to the Client

Each message identifies the Client by name. Numbers are dedicated per Client; you will not receive messages from one Client through a number you opted in to with a different Client.

2. How you opt in

You opt in to a Client’s SMS program by checking an unchecked SMS consent checkbox on the Client’s website contact form, intake form, or in-office paper form. The checkbox is presented alongside a clear disclosure of these SMS Terms, the message types and frequency, opt-out instructions, and links to the relevant Privacy Policy and these SMS Terms.

Consent is not a condition of receiving services from any Client. Submitting a contact form without checking the SMS consent box does not opt you in.

3. Message frequency

Message frequency varies by Client and by the type of program you opted into. Frequency is typically 2 to 4 messages per month, though it may be lower (no messages until your next appointment) or higher (during an active conversation you initiated).

4. Costs

Message and data rates may apply. Your mobile carrier may charge you for sending and receiving SMS messages depending on your wireless plan. 415 Creative and its Clients do not charge you for the messages themselves.

5. Opt-out (STOP)

You can opt out of any 415 Creative SMS program at any time by replying STOP to any message you receive. You may also reply: CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, OPTOUT, or STOPALL.

After you reply STOP, you will receive one confirmation message and no further messages from that Client through our platform. To resubscribe later, reply START or UNSTOP, or opt in again through the Client’s website.

You may also revoke consent by:

  • Calling the Client directly using the phone number listed on its website
  • Emailing the Client’s listed contact address
  • Emailing privacy@415creative.com

6. Help (HELP)

For help, reply HELP to any message. You can also contact 415 Creative directly using the contact information in Section 12, or contact the specific Client whose program you are enrolled in.

7. Supported carriers

Our SMS programs are available on most major U.S. mobile carriers, including AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Sprint, Boost, Cricket, MetroPCS, and Virgin Mobile. Carriers are not liable for delayed or undelivered messages.

8. Privacy

Your mobile phone number, opt-in status, and the content of messages you exchange through our platform are governed by our Privacy Policy. In summary:

  • Mobile information (phone number and opt-in status) is not shared with third parties or affiliates for marketing or promotional purposes.
  • Mobile information is shared only with our SMS delivery subcontractor (Twilio) for the purpose of delivering messages, and with the specific Client whose program you opted in to.
  • No medical, prescription, treatment, diagnosis, or other Protected Health Information is included in any SMS sent through our platform.

9. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to opt in to a 415 Creative SMS program. By opting in, you represent that you are the subscriber to or authorized user of the mobile phone number you provided.

10. Disclaimers

Our SMS programs are provided on an “as is” and “as available” basis. We do not guarantee message delivery, timing, or carrier availability. Message delivery is subject to carrier and device limitations, network congestion, and applicable law.

11. Changes to these SMS terms

We may update these SMS Terms from time to time. The “Last updated” date at the top reflects the most recent version. If we materially change the program description, message types, or your rights under these SMS Terms, we will notify enrolled subscribers by SMS or email.
